Any Spanish companies within the Lets Go Company group that may provide infrastructure, support, marketing or personal data processing services on behalf of ALBION VANTAGE act as third-party service providers and do not hold the status of owners of the Website; information relating to such relationships and to the processing of data on their behalf is set out, where applicable, in the Privacy Policy. Similarly, the project partners associated with the Event are neither the owners of the Website nor the organisers of the Event in relation to Users.
This Website may not be used in connection with any other content, products and/or services not owned by the Organisation and/or its subsidiaries and/or offices.
For the purposes of this Legal Notice, ‘Users’ are individuals who access the Website and/or submit an enquiry or an email to the Website, or who complete a form on the Website or go through a registration process.
2. PURPOSE
This Legal Notice sets out all the terms and conditions governing: a) access to, navigation of and use of the Website; b) the liabilities arising from the use of the Website and the provision and/or contracting of any products or services that may be offered via the Website; and c) the provision and use of the Website’s content. Without prejudice to any provision to the contrary, the foregoing does not prevent the Organisation from establishing specific terms and conditions governing the use, provision and/or contracting of products or services which, where applicable, may be offered to Users via the Website. In any event, such specific terms and conditions shall form an integral part of this Legal Notice.
Mere access to the Website, the completion of forms, the submission of requests for information, enquiries, complaints, offers to contract or for employment and, in general, any act of a similar nature to the foregoing carried out via the forms and/or electronic mailboxes available on the Website shall imply, on your part, your unreserved acceptance of each and every one of the provisions contained in this Legal Notice and that you are deemed to be a User of the Website. Consequently, you must read this Legal Notice carefully and familiarise yourself with its contents.
Where the use, provision and/or contracting of products or services are offered via the Website, the fact that they are used and/or requested by the User shall also imply unreserved acceptance of any specific terms and conditions that may have been established for that purpose, which shall form an integral part of this Legal Notice.
3. ACCESS TO AND USE OF THE WEBSITE
Access to the Website by Users is free of charge. However, the use, provision and/or purchase of any products or services that may be offered by the Organisation may be subject to prior acceptance of formal requirements, such as completing the relevant form, payment of fees and charges, and/or prior acceptance of the specific terms and conditions applicable to them.
The Website is designed so that tickets may be purchased by adults (aged 18 and over) with sufficient legal capacity. The Night Before Christmas Arley Experience is aimed at users aged 0 and over. Those under the age of 18 may only attend and participate with the authorisation of their parents, guardians or legal representatives, and in compliance with the specific terms and conditions applicable to the Event.
Mere access to the Website does not, in itself, imply the establishment of any kind of commercial link or relationship between the Organisation and the User, unless the appropriate means have been established for this purpose and the User has first complied with any requirements that may be set out.
The inclusion on the Website of information relating to products or services offered by the Organisation is for information and advertising purposes only, unless another purpose is expressly stated.
If, in order to use, receive and/or contract any product or service offered via the Website, the User is required to register, they shall be responsible for providing accurate and lawful information, guaranteeing the authenticity of all data entered when completing the pre-established forms to access the products or services in question. If, as a result of registration, the User is provided with a password, they undertake to use it diligently and to keep it confidential. Consequently, Users are responsible for the proper safekeeping and confidentiality of any usernames and/or passwords supplied to them, and undertake not to transfer their use to third parties, whether temporarily or permanently, nor to allow access to unauthorised persons. The User shall be solely responsible for the use and/or purchase of the products or services by any unauthorised third party who uses a password for that purpose as a result of the User’s negligence, lack of due care or the loss of the password by the User.
Furthermore, the User is obliged to notify the Organisation immediately of any incident that could lead to the misuse of usernames and/or passwords, such as theft, loss or unauthorised access to them, so that they can be cancelled immediately. Without prejudice to any other provision contained herein, until such incidents are reported, the Organisation shall be exempt from any liability that may arise from the misuse of usernames or passwords by unauthorised third parties.
In any event, access to, browsing of and use of the Website and, where applicable, the use of or contracting of the services or products offered through it, is carried out under the sole and exclusive responsibility of the User; the User therefore undertakes to diligently and faithfully comply with any additional instructions issued by the Organisation or by authorised staff of the Organisation regarding the use of the Website and its content.
Consequently, the User undertakes to use the content, products and services diligently, correctly and lawfully, in accordance with current legislation and, in particular, undertakes to refrain from:
(i) Using them for purposes or with effects contrary to the law, morality, generally accepted standards of conduct or public order, or contrary to the instructions received from the Organisation.
(ii) Using them for purposes that infringe the legitimate rights of third parties.
(iii) To access and/or use the Website for professional purposes, or to incorporate the Website’s services and content into one’s own business activities.
(iv) To use the content and products, and in particular any information of any kind obtained via the Website or the services, to send advertising, communications for direct sales purposes or for any other commercial purpose, or unsolicited messages addressed to a number of people regardless of their purpose; and to refrain from marketing or disclosing such information in any way.
The use or application of any technical, logical or technological means by virtue of which Users may benefit, directly or indirectly, with or without profit, from the unauthorised exploitation of the Website’s content and/or services is expressly prohibited.
4. DISCLAIMER OF WARRANTIES
THE WEBSITE, INCLUDING, WITHOUT LIMITATION, ALL SERVICES, FEATURES, CONTENT, FUNCTIONS AND MATERIALS PROVIDED THROUGH THE WEBSITE, ARE PROVIDED ‘AS IS’, WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED. THE WEBSITE MAY CONTAIN INFORMATION, OPINIONS, ADVICE, WARNINGS AND STATEMENTS PROVIDED BY VARIOUS SOURCES, AS WELL AS BY ANY USER OF THE WEBSITE, FOR WHICH THE ORGANISATION ASSUMES NO RESPONSIBILITY AS TO THEIR ACCURACY OR RELIABILITY, NOR DOES IT ENDORSE OR APPROVE ANY SUCH INFORMATION, OPINIONS, ADVICE, WARNINGS OR STATEMENTS. Any information published on the website is intended solely for general purposes. THE ORGANISATION DOES NOT GUARANTEE OR ENDORSE THE ACCURACY OR RELIABILITY OF ANY INFORMATION OR CONTENT. CONSEQUENTLY, THE ORGANISATION DOES NOT GUARANTEE THE RELIABILITY, USEFULNESS OR TRUTH OF THE INFORMATION, NOR THE CONTINUITY, ACCURACY OR COMPLETENESS OF SUCH INFORMATION, NOR OF THE RESULTS OBTAINED FROM THE USE MADE OF SUCH INFORMATION, AND SHALL HAVE NO LIABILITY TOWARDS USERS.
THE ORGANISATION ACCEPTS NO LIABILITY AND, TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, EXCLUDES ANY WARRANTIES, WHETHER EXPRESS OR IMPLIED, REGARDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, COMPLETENESS OR TIMELINESS OF THE CONTENT, SERVICES, PRODUCTS, TEXTS, GRAPHICS, LINKS OR OTHER ELEMENTS INCLUDED ON THE WEBSITE, OR THE RESULTS OBTAINED FROM ACCESSING AND USING THE WEBSITE AND/OR ITS CONTENT.
CONSEQUENTLY, THE ORGANISATION DOES NOT GUARANTEE NOR IS IT LIABLE FOR:
(i) THE CONTINUITY OF THE WEBSITE’S CONTENT AND/OR THE LACK OF AVAILABILITY OR ACCESSIBILITY OF THE WEBSITE OR ITS TECHNICAL CONTINUITY;
(ii) THE ABSENCE OF ERRORS IN SUCH CONTENT OR PRODUCTS, OR THAT ANY ERRORS WILL BE CORRECTED;
(iii) THE ABSENCE OF VIRUSES AND OTHER HARMFUL COMPONENTS ON THE WEBSITE OR ON THE SERVER HOSTING IT;
(iv) THE IMPENETRABILITY OF THE WEBSITE AND/OR THE INFRINGEMENT-PROOF NATURE OF THE SECURITY MEASURES IMPLEMENTED THEREON;
(v) where applicable, the lack of usefulness or performance of the website’s content or services;
(vi) ANY DAMAGE OR LOSS CAUSED, TO THEMSELVES OR TO A THIRD PARTY, BY ANY PERSON WHO BREACHES THE TERMS, RULES AND INSTRUCTIONS ESTABLISHED BY THE ORGANISATION ON THE WEBSITE OR THROUGH A BREACH OF ITS SECURITY SYSTEMS;
(vii) ANY OTHER DAMAGES THAT MAY BE CAUSED BY REASONS INHERENT IN THE NON-FUNCTIONING OR MALFUNCTIONING OF THE WEBSITE OR OF ANY WEBSITES TO WHICH, WHERE APPLICABLE, LINKS MAY HAVE BEEN ESTABLISHED.
Notwithstanding the foregoing, the Organisation declares that it has taken the necessary measures, within its capabilities and in accordance with the current state of technology, to ensure the proper functioning of the Website and to prevent the existence and transmission of viruses and other harmful components to Users.
The foregoing shall be understood without prejudice to the rights to which consumers and users are entitled under the applicable mandatory regulations, and shall not limit the Organisation’s liability in cases where such limitation is not permitted by law.
ANY COMMUNICATION OR TRANSMISSION OF CONTENT THAT INFRINGES THE RIGHTS OF THIRD PARTIES AND WHOSE CONTENT IS THREATENING, OBSCENE, DEFAMATORY, PORNOGRAPHIC, XENOPHOBIC, OR WHICH VIOLATES HUMAN DIGNITY OR THE RIGHTS OF CHILDREN, CURRENT LEGISLATION, OR ANY CONDUCT THAT INCITES OR CONSTITUTES THE COMMISSION OF A CRIMINAL OFFENCE.
FURTHERMORE, USERS ARE PROHIBITED FROM INCLUDING OR COMMUNICATING CONTENT THAT: I) IS FALSE OR INACCURATE AND WHICH MISLEADS OR MAY MISLEAD OTHER USERS OR THE ORGANISATION’S STAFF; II) MAY INFRINGE THE INTELLECTUAL OR INDUSTRIAL PROPERTY RIGHTS OF THIRD PARTIES; III) UNDERMINE OR DISPARAGE THE REPUTATION OR CREDIBILITY OF THE ORGANISATION; IV) WHICH ARE CONSIDERED TO CONSTITUTE UNLAWFUL, MISLEADING OR UNFAIR ADVERTISING; AND/OR V) THAT CONTAIN VIRUSES OR ANY OTHER ELECTRONIC ELEMENT THAT COULD DAMAGE OR IMPEDE THE FUNCTIONING OF THE WEBSITE, THE NETWORK, THE ENTITY’S OR THIRD PARTIES’ COMPUTER EQUIPMENT AND/OR ACCESS TO THE WEBSITE BY OTHER USERS.
5. LIMITATION OF LIABILITY AND INDEMNITY
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT, INCLUDING BUT NOT LIMITED TO NEGLIGENCE, THE COMPANY OR ANY OF OUR AFFILIATES, BRANCHES OR ANY OF OUR DIRECTORS, OFFICERS, EMPLOYEES, AGENTS OR CONTENT OR SERVICE PROVIDERS SHALL BE LIABLE FOR ANY DIRECT, INDIRECT, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED, DIRECTLY OR INDIRECTLY, TO THE USE OF, OR INABILITY TO USE, THE WEBSITE OR THE CONTENT, FEATURES, MATERIALS AND FUNCTIONS RELATED THERETO. THE TOTAL LIABILITY OF THE ENTITY, ITS SUBSIDIARIES, BRANCHES, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS OR CONTENT OR SERVICE PROVIDERS TOWARDS USERS FOR ALL DAMAGES, LOSSES AND CLAIMS ARISING FROM THE USE OF THE WEBSITE SHALL BE LIMITED AND SHALL NOT EXCEED THE AMOUNT, IF ANY, PAID BY THE USER TO THE COMPANY FOR THE USE OF THE WEBSITE OR THE PURCHASE OF PRODUCTS OR SERVICES THROUGH THE WEBSITE.
The User undertakes to hold the Organisation and any of its subsidiaries, branches, officers, directors, employees and agents harmless from any claims, liabilities, costs and expenses, including legal fees, arising in any way from the use of the Website, the posting or transmission of any message, content, information, software or other materials via the Website, or for any breach of the law or of the terms and conditions contained in this Legal Notice.
The foregoing shall be without prejudice to the rights to which consumers and users are entitled under applicable mandatory legislation, and shall not limit the Organisation’s liability in cases where such limitation is not permitted by law.
6. TERMINATION OF ACCESS AND USE
The Organisation may, at its sole discretion, deny, withdraw, suspend and/or block access to the Website and/or any services at any time and without prior notice to those Users who breach this Legal Notice and/or any terms of use, and may delete their registration and all information and files relating thereto. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE COMPANY SHALL NOT BE LIABLE TO THE USER IN ANY WAY FOR THE TERMINATION OF ACCESS TO THE WEBSITE FOR THE REASONS SET OUT IN THIS PARAGRAPH.
7. INTELLECTUAL AND INDUSTRIAL PROPERTY RIGHTS
The Organisation is the owner of, or has obtained the relevant licence for, the rights to exploit the intellectual and industrial property and image rights relating to the content available via the website, including, by way of example only and without limitation, texts, graphic designs, drawings, codes, software, photographs, videos, sounds, databases, indexes, images, trade marks, logos, expressions and information and, in general, any other creation protected by national legislation and international treaties on intellectual and industrial property (hereinafter collectively referred to as the ‘Content’).
The products and services offered on the Website, as well as the intellectual and industrial property rights relating thereto, are and shall remain the exclusive property of the Organisation.
All intellectual and industrial property rights in the Content are reserved and, in particular, it is prohibited to modify, copy, reproduce, communicate to the public, adapt or distribute in any way all or part of the Content included on the Website, for public or commercial purposes, unless prior, express and written authorisation has been obtained from the Organisation or, where applicable, from the relevant rights holder. By way of example, the use of any technology to extract and collect information and content from the Website is prohibited.
The User’s access to and browsing of the Website shall under no circumstances be construed as a waiver, transfer, licence or total or partial assignment of the aforementioned rights by the Organisation. Consequently, it is not permitted to remove, circumvent or manipulate the copyright notice (e.g. ‘copyright’ or ‘©’) or any other information identifying the rights of the Organisation or its rights holders incorporated into the Content, nor the technical protection measures, digital watermarks or any other information and/or identification mechanisms that may be contained therein.
References to trade names and trade marks (whether registered or not), logos or other distinctive signs, whether owned by the Organisation or by third-party companies, imply a prohibition on their use without the consent of the Organisation or their legitimate owners. At no time, unless expressly stated otherwise, does access to or use of the Website and/or its Content confer upon the user any rights whatsoever over the trade marks, logos and/or distinctive signs included therein and protected by law.
8. LINKS
8.1 Links from the Website to other websites
The Organisation may provide links, either directly or indirectly, to online resources or web pages located outside the Website. The presence of these links on the Website is for information purposes only; they do not in any way constitute an invitation to contract for products and/or services offered or that may be offered on the linked web pages, nor do they imply the existence of any commercial or dependent relationship with the person or entity that owns the linked web page. In such cases, the Organisation shall not be responsible for establishing the general and specific terms and conditions to be taken into account in the use, provision or contracting of these services by third parties and, therefore, cannot be held liable for them.
The Organisation does not have the authority, nor the human or technical resources, to ascertain, control or approve all the information, content, products or services provided by other websites to which links may be established from this Website. CONSEQUENTLY, THE ORGANISATION SHALL NOT BE LIABLE IN ANY WAY FOR ANY ASPECT RELATING TO THE WEBSITES TO WHICH LINKS MAY BE PROVIDED FROM THIS WEBSITE, IN PARTICULAR, BY WAY OF EXAMPLE AND WITHOUT LIMITATION, THEIR OPERATION, ACCESS, DATA, INFORMATION, FILES, THE QUALITY AND RELIABILITY OF THEIR PRODUCTS AND SERVICES, THEIR OWN LINKS AND/OR ANY OF THEIR CONTENT, IN GENERAL.
Notwithstanding the foregoing, should the Organisation become aware that the activity or information to which such links refer is unlawful, constitutes a criminal offence or may infringe the property or rights of a third party, it shall act with due diligence to remove or disable the relevant link as soon as possible.
Furthermore, should Users become aware that activities carried out via these third-party websites are unlawful, they must immediately notify the Organisation so that the link providing access to such websites may be disabled.
8.2 Links from other websites to the Website
If any User, organisation or website wishes to establish any kind of link to the Website, they must comply with the following provisions:
(i) They must obtain the Organisation’s prior, express and written authorisation.
(ii) The link may only direct to the Website’s home page, unless expressly authorised otherwise.
(iii) The link must be absolute and complete; that is to say, it must take the User, with a single click, to the home page and must cover the entire screen of the Website’s home page. Under no circumstances, unless the Organisation authorises otherwise, may the website from which the link is made reproduce the Website in any way, include it as part of its own website or within one of its ‘frames’, or create a ‘browser’ over any of the pages of the Website.
(iv) The website from which the link is established must not state in any way that the Organisation has authorised such a link, unless this is actually the case. If the entity linking from its website to the Website correctly wishes to include on its website the trademark, name, trade name, sign, logo or any other identifying mark of the Organisation and/or the Website, it must first obtain the Organisation’s prior, express and written authorisation.
(v) In any event, the Organisation prohibits the creation of a link to the Website from any web pages containing material, information or content that is unlawful, illegal, degrading, obscene or, in general, that contravenes public morality, public order, current legislation, generally accepted social norms or infringes the legitimate rights of third parties.
9. PRIVACY POLICY
Where it is necessary for the User to register or provide personal data (including, amongst other cases, to access services; request information; purchase products; or submit forms, enquiries, complaints or contract applications), the User will be informed of the need to provide their personal data.
In all cases, the collection and processing of personal data shall be carried out in accordance with the principles and obligations of the applicable data protection legislation, and in accordance with the provisions of the Privacy Policy , which forms an integral part of this Legal Notice.
10. DURATION AND AMENDMENTS
The Organisation reserves the right to amend any terms and conditions of this Legal Notice without prior notice and/or any specific conditions which, where applicable, may have been established for the use and/or procurement of the products or services provided via the Website, whenever it deems it appropriate, for business reasons or in order to adapt to legislative and technological changes, such amendments being valid and taking effect from the date of publication on the Website.
The period of validity of these terms of use therefore coincides with the period during which they are displayed, until they are amended in whole or in part, at which point the amended terms of use shall come into force.
The Organisation may terminate, suspend or interrupt access to the published content at any time without prior notice, without the User being entitled to claim any compensation. Following such termination, the prohibitions on the use of the content, as set out above in this Legal Notice, shall remain in force.
11. COMMUNICATIONS
For any communication between the Organisation and the User, the User must contact the Organisation at the postal and/or email address indicated above. In all cases, communications from the Organisation to the User shall be made in accordance with the contact details provided or supplied. The User expressly accepts the use of email as a valid method for the exchange of information and the sending of communications between and/or with the Organisation.
12. GENERAL PROVISIONS
The headings of the various clauses are for information purposes only and shall not affect, qualify or modify the interpretation of this Legal Notice.
In the event of any discrepancy between the provisions of this Legal Notice and any specific terms and conditions that may be established in respect of the products or services offered on the Website, the provisions of the specific terms and conditions shall prevail.
Should any provision or provisions of this Legal Notice be deemed null and void or unenforceable, in whole or in part, by any court, tribunal or competent administrative body, such nullity or unenforceability shall not affect the other provisions of the Legal Notice nor any specific terms and conditions that may have been established.
The Entity’s failure to exercise or enforce any right or provision contained in this Legal Notice shall not constitute a waiver thereof, unless acknowledged and agreed in writing by the Entity.
13. APPLICABLE LAW AND COMPETENT COURTS
This Legal Notice and any relationship arising from or in connection with its acceptance shall be governed by the laws of England and Wales, without prejudice to any rights that consumer Users may have under the mandatory consumer protection rules of their country of habitual residence.
Without prejudice to the rights of consumer Users to bring proceedings before the courts of their country of residence in accordance with the applicable legislation, the courts of England and Wales shall have jurisdiction to resolve any dispute arising out of or in connection with this Legal Notice and/or any relationship arising from your acceptance thereof.
